New Delhi: March 02, 2026:

The Supreme Court of India has stayed a Delhi High Court order that mandated a uniform retirement age of 60 years for all ranks in the Indian Coast Guard (ICG). The apex court directed the Union government to constitute an expert committee to comprehensively review service conditions, including recruitment, promotions, and retirement norms for the maritime force.

This decision comes after the Centre challenged the Delhi High Court’s ruling, arguing that the Coast Guard cannot be equated with the Central Armed Police Forces (CAPFs) such as the CRPF or BSF, given its unique operational role and structure.

Case Background

  • The Delhi High Court had earlier struck down provisions of the Coast Guard (General) Rules, 1986, which prescribed different retirement ages for officers depending on rank.
  • The HC ruled that all Coast Guard personnel should retire at 60, like CAPFs.
  • The Union government appealed to the Supreme Court, contending that the HC’s order interfered with service rules and operational requirements.
  • A bench led by Chief Justice Surya Kant and Justice Joymalya Bagchi stayed the HC’s order and issued notice to the respondents.

Supreme Court’s Observations

  • Operational Differences: The Coast Guard’s duties—maritime surveillance, search and rescue, and coastal security—require distinct service conditions.
  • Expert Review Needed: The court directed the Centre to form a panel of experts to examine recruitment, promotion, and retirement policies.
  • Balance of Interests: While acknowledging concerns about fairness, the court emphasized that operational efficiency must guide retirement norms.

Broader Implications

  • For Coast Guard Personnel: Retirement age remains rank-based until expert panel submits recommendations.
  • For Government: Provides relief from immediate implementation of HC’s order, allowing time for policy review.
  • For Judiciary: Demonstrates balance between equality principles and operational requirements.
  • For Policy Makers: Highlights need for specialized service rules tailored to maritime security forces.

Conclusion

The Supreme Court’s stay on the Delhi High Court’s order regarding Coast Guard retirement age underscores the complexity of balancing equality principles with operational efficiency. By directing the Centre to form an expert panel, the court has ensured that future decisions will be based on a comprehensive review of service conditions.

This ruling provides temporary relief to the government while keeping the door open for reforms that could align Coast Guard policies with modern security needs.
