Judgment
Accused No.1 in Crime No.279/2026 registered by Saligrama Police Station, Mysuru, for the offences punishable under Sections 126(2), 352, 351(2), 351(3), 109(1) and 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail.
Heard the learned counsel for the parties.
FIR in Crime No.279/2026 was registered by Saligrama Police Station, Mysuru, for the aforesaid offences against petitioner and two others based on the first information dated 05.07.2026 received from Mahamad Mannan S/o Naseer Ahamad. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.5222/2026, which was dismissed on 28.07.2026 as against him by the jurisdictional Sessions Court. It is under these circumstances, petitioner is before this Court.
Material on record would go to show that in respect of the alleged incident that had taken place on 05.07.2026, there is a case and counter case registered Crime No.279/2026 and Crime No.280/2026 by the very same police station. Injured victim Mahamad Mannan has suffered only simple injuries in the incident in question as a result of assault made by accused in the present case. FIR in Crime No.280/2026 was registered based on the first information received from the wife of accused No.2 and mother of accused No.1 as against seven persons. Father of the first informant in the present case is also an accused in Crime No.280/2026. Considering the aforesaid aspects of the matter and the background in which the incident in question had taken place, the following order:-
The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.279/2026 registered by Saligrama Police Station, Mysuru, for the offences punishable under Sections 126(2), 352, 351(2), 351(3), 109(1) and 3(5) of BNS, 2023, subject to the following conditions:
The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/-with two sureties for the likesum to the satisfaction of the investigating officer.
Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon.
The petitioner shall not involve in similar offences in future.
