Judgment
Accused nos.1 & 3 in Crime No.213/2026 registered by Belur Police Station, Hassan District, for the offences punishable under Sections 115(2), 352, 118(1), 189(2), 191(2), 109 & 125(a) of BNS, 2023 are before this Court in this petition filed under Section 482 of BNSS, 2023 seeking anticipatory bail.
Heard the learned Counsel for the parties.
FIR in Crime No.213/2026 was registered by Belur Police Station, Hassan District, for the aforesaid offences against petitioner no.1 and others, based on the first information dated 16.07.2026 received from Ashim, who is one of the injured victim in the present case. Petitioners, who are arrayed as accused nos.1 & 3 had approached the jurisdictional Sessions Court in Crl. Misc. No.784/2026, which was rejected on 31.07.2026. Therefore, they are before this Court.
Perusal of the material on record would go to show that, in respect of the alleged incident that had taken place on 15.07.2026 within the jurisdiction of Belur Police Station, there is a case and counter case registered in Crime No.212/2026 and Crime No.213/2026. Crime No.212/2026 is registered against Ashim, who is the first informant in the present case and others, based on the first information submitted by accused no.11 - Roshan.
A reading of the first information would go to show that, there is a dispute between the two parties concerning the daughter of Imthiyaz, who is an accused in the present case. It is in this background, the parties had fought against each other and injured victims in both the cases, have suffered only simple injuries. Petitioners have undertaken to cooperate with the police for the purpose of investigation. Under the circumstances, the following order:
Petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioners in the event of their arrest in Crime No.213/2026 registered by Belur Police Station, Hassan District, for offences punishable under Sections 115(2), 352, 118(1), 189(2), 191(2), 109 & 125(a) of BNS, 2023, subject to the following conditions:
The petitioners shall appear before the Investigating Officer in the present case within a period of fifteen days from the date of receipt of certified copy of this order on executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) each with two sureties for the likesum to the satisfaction of the investigating officer/jurisdictional Court.
The petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons.
The petitioners shall not tamper with the prosecution witness and they shall co-operate with the Police for investigation and appear before them whenever called upon.
The petitioners shall not involve in similar offences in future.
