Learned counsel for the petitioner has filed a memo under the signature of the petitioner. Learned counsel for the petitioner submits that the dispute between the parties is settled as the respondents have paid a sum of Rs.6,50,000/- towards full satisfaction of the claim of the petitioner, in terms of the settlement arrived at. The payment is said to have been made through demand draft, the particulars of which are mentioned in the memo.
It is further submitted by the learned counsel for the respondents that the respondents had issued a cheque for a sum of Rs.6,50,000/- towards discharge of the claim made by the petitioner. The cheque is has not yet encashed and it is dated 27.04.2024. It is submitted by the learned counsel for the respondents that, since the amount is paid through demand draft mentioned in the memo for withdrawal, the respondents have no obligation to pay the amount through the cheque already sent to the petitioner.
Learned counsel for the petitioner would submit that the said cheque of Rs.6,50,000/- would be returned to the respondents.
Memo and submissions are placed on record.
The petition is dismissed as withdrawn. It is made clear that on encashment of the demand draft the petitioner has no claim against the respondents in respect of the transaction referred in the petition.
