This Court is flooded with the bunch of petitions, as one in hand particularly of district Kulgam. In this view of the matter, it had become expeditious to seek the presence of Zonal Education Officer, HC Gam, Kulgam along with the record pertaining to the case as to whether the applicant is continuing as on date from the initial date of engagement.
The matter came up for consideration today. ZEO, HC Gam, Kulgam namely, Noor Mohammad Khandey is present before the Court. He has referred to his communication dated 14.09.2026 under his seal and signature, wherein it has been mentioned that applicant is continuing till date as per the duty slip issued by concerned HOI vide No.BMS/03/2026 dated 20.08.2026.
Mr. Rais Ud Din Ganaie, learned DAG submits that the reason for not considering the case of the applicant herein is that she has never applied in pursuance to the scheme. At this stage, the case can be disposed of at the request of learned counsel for the applicant.
Accordingly, without issuing notice to the respondents, the instant OA is disposed of by providing that the applicant will file her application before the competent authority, if the scheme permits so, and the competent authority will consider the case of the applicant in accordance with her eligibility as per provisions in the scheme and accordingly, pass an appropriate order as warranted under law, strictly in terms of scheme and her eligibility. It is made clear that in issuance of the said order, we have not relaxed any of the conditions or rules, as are required to be followed by the applicant, while seeking such consideration. Instant OA No.864/2026 stands disposed of. No order as to costs.
