D.K. Sinha, J.—The Petitioner is in custody since 5.8.2010 for the alleged offence under Sections 395/412 of the Indian Penal Code. The complicity of the Petitioner appeared in the confessional statement of the co-accused Rajesh Das and it was alleged that one DVD was recovered from the possession of the Petitioner which was not the subject matter of the dacoity. The Petitioner was never put on T.I. Parade. He earlier moved for bail in B.A. No. 8023 of 2010 which was permitted to be withdrawn on 22.12.2010 however, with the liberty to renew his prayer in future and pursuat to such liberty the Petitioner has renewed his prayer.

In the circumstances, the Petitioner Zakir @ Dabbu Khan @Zakir Khan is directed to be released on executing bail bond of Rs. 10,000/-(Rupees ten thousand) with two suretis of the like amount each to the satisfaction of the Chief Judicial Magistrate, Dhanbad in Katras P.S. Case No. 198 of 2010 corresponding to G.R. No. 2211 of 2010 with the conditions that the bailors would be his near relatives and he would appear in the court below regularly.
