This second petition under section 528 of BNSS has been filed seeking direction to the trial court to conduct speedy trial in respect of case RCT. No.493/2021 pending before JMFC, Lateri District Vidisha and conclude the same in a time bound manner.

Learned counsel for the petitioner submits that petitioner is suffering jail sentence in some other case and due to the pendency of this case, he is not being extended benefit of parole and if his case is disposed off at the earliest then he will be entitled for the parole. He further submitted that earlier co-ordinate Bench of this Court passed order dated 27.01.2025 in M.Cr.C. No.46838/2024 and directed the trial court to conclude the trial court the aforesaid case within one year. But, till now, there is no progress and the case is kept pending without any reasons. Therefore, learned counsel prays for a direction to the learned trial court for expediting the trial and disposal of the same, as early as possible.

Learned counsel for the State has not opposed the prayer.

Heard learned counsel for the parties and perused the record.

From perusal of the record this Court finds that order dated 27.01.2025 in M.Cr.C. No.46838/2024 has been passed by the co-ordinate Bench of this Court in the same regard, but the trial court has not complied with the same.

Hence, this petition is disposed of with a direction to the trial Court that aforesaid case which is pending since 23.11.2021 shall be disposed of as early as possible and preferably within a period of three months and report in this regard to sent to this Court.

Registry is directed to list this case after three months along with the aforesaid compliance report under the head "Direction Matters"

With the aforesaid, present petition is disposed of.
