A.L. Dave, J.—Rule. Learned Addl. Public Prosecutor, Mr. Prachchak, waives service of notice of rule on behalf of the State.

Learned Advocate for the applicants, seek permission to withdraw the application in respect of the applicant No. 2-Jahid Yunish Mohmand Safi Musalman. Permission, as prayed for, is granted. Application stands disposed of as withdrawn in respect of applicant No. 2. Rule is discharged in respect of applicant No. 2.

Heard learned Advocate for the applicants and learned A.P.P. for State.

Shahjaha, daughter of applicant No. 1, Yunish Mohmad Safi Musalman, is getting married on 16/7/2006. The ceremonies commence from 10/7/2006 and end on 17/7/2006. We notice that the reception lunch is fixed on 17/7/2006. The marriage is to be solemnized at village Salappur, Dist: Merath, U.P. Considering the journey, that the applicant No. 1 may have to undertake and time consumed therein, we are of the view that the ends of justice would be met, if applicant No. 1, is released on temporary bail for a period of 10 (Ten) days. The applicant No. 1 shall be released on temporary bail for a period of 10 (Ten) days from the date of his release on his executing a personal bond of Rs. 5,000/- (Rupees Five Thousand Only) and on his depositing an amount of Rs. 2,000/- (Rupees Two Thousand Only) with the Jail Authority on following conditions that applicant No. 1 shall; not leave India; not indulge in any illegal activity; surrender before the Jail Authorities on completion of 10 days from the date of his release.

Rule is made absolute in respect of applicant No. 1.
