Judgment
Heard on I.A.No.03/2021, for taking document on record.
On due consideration, I.A.No.03/2021 is allowed and the documents are taken on record.
Also heard on I.A.No.01/2021, for grant of temporary bail to the applicant.
The applicant has been arrested in connection with Crime No.146/2021, registered at Police Station Bemetara, District Bemetara (C.G.) for the
offence punishable under Section 306 IPC.
Learned counsel for the applicant submits that the wife of appellant has symptoms like COVID-19 and her condition is serious. He also submits that
her treatment is going on in Community Health Center, Simga, and he has also filed medical document in this regard (Annexure D-1). Therefore,
interim bail may kindly be granted to the applicant for his wife's treatment.
Learned counsel for the State formally opposed the prayer for interim bail.
I have heard learned counsel for the parties and perused the record.
Having heard learned counsel for the parties, having considered the fact that the applicant's wife has Covid symptoms and is undergoing treatment in
CHC, Simga, I am inclined to release the applicant on temporary bail.
Accordingly, I.A.No.01/2020 is allowed.
It is directed that the applicant shall be released on temporary bail for one month on his furnishing a personal bond in sum of Rs.25,000/- with one
solvent surety in like sum to the satisfaction of the concerned trial Court. The applicant shall positively surrender himself before the concerned trial
Court on 11.06.2021.
