Perusal of the record shows that even on several previous dates none had appeared on behalf of the petitioner consecutively, neither the counsel nor petitioner himself nor anybody else representing him had appeared.
It is not difficult to see that the petitioner is disinterested to pursue this matter for reasons best known to him and it is a clear case of non-prosecution. As per Order dated 28.11.2022 the notice to the respondents could not be issued as the fresh address was not filed on behalf of the petitioner as was required. The order sheets dated 08.07.2022 and 11.03.2022 also show that because of the non-supply of the respondent’s set notice could not be issued. A number of earlier order sheets also show that the time to remove the defects was sought but they were not removed for a long time resulting in the procrastination of the petition. The petition is pending since 2018 and there is no justification to keep it pending for indefinite period of time.
As the petitioner is not pursuing the matter in right earnest and is not doing the needful and not taking steps in order to assist the Commission to proceed further in the matter the petition stands dismissed in non-prosecution.
The Registry is requested to send a copy each of this Order to all parties in the petition and to the learned counsel for the petitioner. The stenographer is requested to upload this Order on the website of this Commission immediately.
