Repeatedly called out intermittently.
Neither the learned counsel for the petitioner, nor any proxy counsel, nor anybody else representing the petitioner has appeared.
No adjournment letter has been sent.
The office report shows that as the respondent’s set for respondent no. 2 has not been filed, the notice could not be resultantly issued to respondent no. 2. The last Order dated 20.04.2023 reads as follows:
“As per Office Report, notice could not be issued to the Respondent No. 2, as the Petitioner has not filed the Respondent’s set for the Respondent No. 2. Let it be filed within three weeks. Whereafter, the Office shall issue notice to the Respondent No. 2, returnable on 22.08.2023.
List on 22.08.2023.”
The office report still indicates that the respondent’s set has not been filed for respondent no. 2 and hence notice could not be issued even now. Today nobody has even appeared for the petitioner. It is not difficult to see that adequate steps / assistance is not being rendered to allow the Commission to proceed further with the matter and it is a case of non-prosecution.
The petition stands dismissed in default / non-prosecution as such. However, in the interest of justice it may be observed that if the petitioner is interested in pursuing the matter in right earnest and feels aggrieved by this Order he may move appropriate recall/restoration application within three months from today.
The Registry is requested to send a copy each of this Order to all parties in the petition and to their learned counsel. The stenographer is requested to upload this Order on the website of this Commission immediately.
