Judgment
This Criminal Petition has been filed by the petitioner seeking release of the seized motor vehicle, namely, a Swift Car bearing Registration No.TG-35-8495, in his favour.
Heard Ms.D.Vandana, learned counsel representing Mr.T.Rajashekar, learned counsel for the petitioner and Mr.Jithender Rao Veeramalla, learned Additional Public Prosecutor for respondents.
When this Court raised a query regarding the maintainability of the present Criminal Petition on the ground that the petitioner, without approaching the learned trial Court seeking interim custody or release of the vehicle, had straightaway approached this Court and filed the present Criminal Petition, at that stage, learned counsel for the petitioner submitted that the petitioner may be granted liberty to file an appropriate application before the concerned jurisdictional Court and on such application, the learned trial Court may be directed to consider the same and pass appropriate orders within a stipulated time.
Learned Additional Public Prosecutor has not opposed the above submission.
In view of the same, and without expressing any view on the merits of the case, the petitioner is granted liberty to file an appropriate application before the jurisdictional Court. On such application, the learned trial Court is directed to pass appropriate orders in accordance with law, as expeditiously as possible, preferably within a period of ten (10) days from the date of receipt of a copy of this order.
Accordingly, the criminal petition is disposed of. Miscellaneous applications, pending if any, shall stand closed.
