Judgment
Kurian Joseph, C.J.—The writ petition has been filed with following prayers:
(A). Wirt of Mandamus may kindly be issued thereby directing the respondents to re-fix the pay Scale of the petitioner on the basis of promotion as DPE in consequence upon the Office order No. EDN-H(12)B(6)-24/2007- Promotion dated 21.7.2007 issued by respondent No. 2 from the date of option dated 26.7.2007 given by the petitioner alongwith all consequential benefits.
(B) Wirt of Certiorari maybe issued thereby quashing and setting aside Office Order EDN-(H)(12) B(6)20/2005 dated 04.05.2009 issued by respondent No. 2 and letter No. EDN-MND (Pay Fix) 1/2009 26373 dated 19.08.2009 issued by respondent No. 3.
There is no reply as yet. There will a direction to first respondent/second respondent to look into the matter with notice to the petitioner and take appropriate action in the matter adverting to the submissions made in the writ petition within a period of three months from the date of production of a copy of this Judgment alongwith a copy of writ petition by the petitioner. In case the petitioner requests for an opportunity of hearing, the same shall also be granted. The consequential benefits to which the petitioner, if found eligible, the same shall be disbursed to him within a period of another one month.
