This petition is filed under Article 226 of the Constitution of India, seeking the following relief:

“to issue any writ or order or direction more particularly one in the nature of writ of Mandamus declaring the impugned termination proceedings dated 30.08.2024, issued by the 3rd respondent as illegal arbitrary, unconstitutional, discriminatory in gross violation of principles of natural justice and consequently set-aside the same and direct the respondents to continue the services of the petitioner in the 2nd respondent trust ..”

The case of the petitioner is that he was initially appointed as Joint Executive Officer (Technical) on contract basis on 25.10.2021, for a period of one year. Thereafter, the said contract was extended vide proceedings dated 09.11.2023, with effect from 26.10.2023, for a further period of one year. However, the grievance of the petitioner is that, though the petitioner is entitled to work on a contract basis until 25.10.2024, the respondents have issued the impugned proceedings dated 30.08.2024, directing the Executive Officer (Medical Audit), Dr. NTR University, to make alternative arrangements with the existing staff by duly relieving the petitioner from his services on the ground that his contract period has expired on 06.08.2024. Hence, the present Writ Petition.

Heard learned counsel for the petitioner and learned counsel appearing for the respondents.

On a perusal of the impugned proceedings dated 09.11.2023, it can be seen that the contract period of the petitioner was extended for a further period of one year, with effect from 26.10.2023, as Joint Executive Officer (Technical), Dr.YSR Aarogyasri Health Care Trust. Therefore, the petitioner is entitled to be continued till 25.10.2024.

In view of the same, instead of keeping the Writ Petition pending, this Court feels it appropriate to allow the Writ Petition, by setting aside the impugned proceedings dated 30.08.2024, duly directing the respondents to continue the petitioner till the date of expiry of the contract, i.e., 25.10.2024.

Accordingly, the Writ Petition is allowed. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall also stand closed.
