The petitioner is arraigned as Accused No.11 in Crime No.79 of 2025, on the file of I Town Police Station, Proddatur, for the alleged offence under Sections 318(4), 61(2), 111, 112(2) read with Section 3(5) of the BNS and Section 9(1) of the Andhra Pradesh Gaming Act, 1974.
Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor.
The learned Assistant Public Prosecutor, on written instructions, submits that the petitioner is facing one more crime which is under investigation stage.
In such circumstances, Section 111 and 112(2) of the BNS would not be made applicable in the facts of the case.
Accordingly, the Criminal Petition is disposed off by directing the Station House Officer, I Town Police Station, Proddatur, to complete the investigation without taking any coercive steps against the petitioner, as the offence under Sections 111 and 112(2) of the BNS cannot be made out against the petitioner.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
