Judgment
18.03.2025: Heard Counsel for the Appellant and Counsel appearing for the Liquidator.
This Appeal has been filed against the order dated 04.03.2025 passed by the Adjudicating Authority (National Company Law Tribunal) Court Room No.1, Mumbai Bench in IA No.5114 of 2024. IA No.5114 of 2024 has been filed by the Appellant- Successful Bidder praying for various relief. The interim order was also passed on 25.10.2024 which directed as follows:-
“4. The Ld. Counsel for the Applicant presses for interim directions to the Respondent after making a prima-facie case. Upon consideration of the submissions, this Bench directs the liquidator not to proceed with the auction pursuant to notice of sale dated 17.10.2024 any further.”
The application which has been filed by the Appellant has been now listed on 19.03.2025 i.e. tomorrow.
Counsel for the Liquidator submits that no notice for auction has yet been issued. Matter being listed tomorrow i.e. 19.03.2025, we see no reason to entertain this appeal at this stage. We, however, observe that it is open for the Appellant to press for any interim relief before the Adjudicating Authority and subsequent proceeding shall take place in pursuance of the order passed by the Adjudicating Authority. We make it clear that we are not expressing any opinion on the merits of the application. It is for the Adjudicating Authority to take a decision. Adjudicating Authority shall endeavor to dispose of as early as possible.
Appeal is disposed of.
