Judgment
Heard Learned Senior Counsel Mr Virender Ganda appears on behalf of the Appellant as well as Learned Counsel for the Respondent.
This appeal has been filed against the Interlocutory Order dated 18th May, 2022 passed by the Adjudicating Authority (National Company Law Tribunal, New Delhi, Court-VI) in I.A. No. 2268 of 2022. IA was filed by the OC seeking direction that till the next date of hearing Respondent for restraining from selling/transferring/alienating/disposing its assets. The Adjudication Authority fixed the matter on 10th June,2022 and 10 days time was given to the Appellant to file its Reply. The matter was fixed for 10, June 2022 and interim order was granted only till the next date of hearing.
We are of the view that this is not a case to be entertained in Appeal. Learned Sr. Counsel submits that the order passed by the Adjudicating Authority needs modification/variation. It is open for the Appellant to make prayer for such relief before Adjudicating Authority regarding the Interim Order passed on 18 May, 2022 as may be advised.
We make it clear, that we are not expressing any opinion on merits of the case.
Adjudication Authority to consider all submissions and take appropriate decision with regard to the I.A. No. 2268/2022.
Appeal is disposed off.
