Judgment
This application, under Section 14 of the AFT Act 2007, has been filed by a serving Warrant Officer of the Army Postal Service who is aggrieved by his posting to a field station in spite of being a low medical category; his abrupt reversion to his previous unit 1 CPBO, New Delhi and his previous unit's refusal to take him on strength and resolve his posting.
Heard both parties on the interim prayer to permit the applicant join 1 CPBO. On ascertaining the whereabouts of the applicant, the Departmental representative Maj Sonali stated that the individual was staying in his service quarters at 1 CPBO, which he had retrained on his posting to field. Maj Solani also added that the applicant's fresh posting was under consideration and that pending issue of the posting order he would be attached to 1 CPBO.
Having heard both parties, we direct the respondents to attach the applicant to 1 CPBO till the finalization of his fresh posting order.
Issue notice. Maj Sonali, the Departmental representative accepts notice on behalf o the respondents. Let counter affidavit be filed within two weeks. List the matter before Court on 17th September, 2021.
