Judgment
A. Guneshwar Sharma, J
[1] Heard Mr. M. Rendy, learned counsel for the petitioner and Mr. Shyam Sharma, learned G.A. for the State respondent.
[2] The petitioner, who is ASI working in Manipur Police, was transferred by common order dated 26.06.2024 from Imphal West to Jiribam. By the present writ petition, the petitioner is praying for reviewing/reconsidering the transfer order to Jiribam on the ground that he is looking after his ailing mother.
[3] On the other hand, Mr. Shyam Sharma, learned G.A. for the State respondents, draws the attention of this Court to the decision of the Hon’ble Supreme Court reported as (2010) 13 SCC 306, para 12 and (2006) 9 SCC 583, para 6 holding that in the matter of transfer, the Court ought not interfere as the same is done by the authorities in the exigency of service and prays that writ petition may be dismissed.
[4] Mr. M. Rendy, learned counsel for the petitioner, submits that writ petition may be disposed of by granting the petitioner one week’s time to join his new place of posting at Jiribam.
[5] Mr. Shyam Sharma, learned G.A. for the State respondent, has no objection to the alternative prayer of the petitioner.
[6] Recording this, writ petition is disposed of by giving one weeks’ time i.e. till 12.07.2024 for joining to the new place of posting at Jiribam.
[7] With this observation, writ petition along with misc. application is disposed of.
[8] Furnish a copy of this order to the learned counsel appearing for all the parties.
