Heard Smt. V. Deepti, learned counsel for the applicant and Smt K. Rajitha, learned Senior Central Government Standing Counsel for the
respondents.
The applicant was appointed as an Inquiry Officer in a departmental case on 01.12.2020. He submitted the inquiry report on 17.03.2021 and the 2nd
respondent has sanctioned the payment of T.A. and the secretarial expenses etc on 18.03.2021. Though the sanction has been issued, Respondent
No.3 has not released the payment and has insisted for submission of an undertaking. The applicant has submitted an undertaking and even then, the
payment has not been released. The applicant has retired on 31.10.2020. The contentions of the applicant are that there is no response to the legal
notice issued by the applicant on 11.05.2021. Besides, the rejection is violative of the DoPT OM dated 31.07.2012. The applicant has also stated that
his case is covered by the order of this Tribunal in OA/320/2021.
In view of the above, it would be appropriate to direct the respondents to dispose of the legal notice issued by the applicant on 11.05.2021.
Accordingly, the respondents are directed to dispose of the legal notice dated 11.05.2021/ representations dated 20.05.2021 & OA/381/2021
25.05.2021 by issuing a speaking and reasoned order, within a period of eight weeks from the date of receipt of a copy of this order, in accordance
with rules / law.
With the above direction, the O.A. is disposed of at the admission stage. No order as to costs.
