RULE. Learned Additional Public Prosecutor waives service of rule on behalf of the respondent — State.
In this case, previously temporary bail was granted by this Court by order dated 24.05.2021 passed in Criminal Misc. Application No.8395 of 2021 on the ground of medical treatment of his wife.
Learned advocate for the applicant has submitted that the condition of applicant's wife is deteriorating day by day and she is admitted in the hospital and is on ventilation therapy as the general condition of the wife of the applicant is very serious. The applicant has produced certificate issued by Dr.Nilesh T. Shah, Ahmedabad and has submitted that the wife of the applicant is under treatment and she is suffering from Acute COVID-19 Pneumonia and she is having difficulty in breathing and not maintaining saturation with the High flow Oxygen therepy and therefore at present she is on ventilation therepy.
Heard learned advocate for the applicant as well as learned APP for the respondent-State.
Considering the ground advanced by the applicant for extension of temporary bail, and the certificate produced by Dr. Nilesh Shah that Mrs.Sandhya Vivek Bhai Hundlani is under treatment as she is suffering from Acute COVID-19 Pneumonia and also having difficulty in breathing and not maintaining saturation with the High flow Oxygen therepy, as well as the health of the wife is deteriorating day by day and not only that she is required to be under ventilation therepy for further period, the present application requires consideration. Hence, the present application is partly allowed. The period of temporary bail, which was granted by this Court vide order dated 24.05.2021 passed in Criminal Misc. Application No.8395 of 2021, is extended for a further period of One Week on the same terms and conditions. The applicant shall surrender to the Jail Authority after completion of the said temporary period, without fail.
Rule is made absolute to the aforesaid extent only.
Registry is directed to send a copy of this order to the concerned Jail Authority through fax or e-mail forthwith.
