Judgment
Ambuj Nath, J
Heard the parties.
Petitioner has been made accused in connection with Ramgarh P.S. Case No. 44 of 2024 for the offences registered under sections 498-A, 304-B and 34 of the Indian Penal Code, pending in the court of learned Chief Judicial Magistrate, Ramgarh.
On 27.02.2024 daughter of the Informant died in her matrimonial home due to hanging.
From perusal of the case diary, it appears that all the independent witnesses have stated that the deceased was suffering from T.B due to which, she was stressed and she committed suicide. Documents relating to the treatment of T.B of the deceased have been annexed with this bail application.
Mr. Pranav Kumar, learned counsel appearing on behalf of the Informant has vehemently opposed the prayer for bail.
It appears that at the time when the deceased committed suicide, petitioner was in New Delhi to appear in UPSC Exam. It further appears that the all the family members of the petitioner have been implicated in this case, but police has not submitted charge sheet against them. It further appears that the independent witnesses have stated that the deceased was suffering from T.B which is substantiated by the prescription annexed with this bail application and because of stress, she has committed suicide.
Considering the aforesaid facts, petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Ramgarh in connection with Ramgarh P.S. Case No. 44 of 2024.
