This application seeks execution of order dated 21.02.2022 in O.A No. 136/2022, Vivek Kamboj & Ors. V. Union of India & Ors. By the said order, the Tribunal considered the grievance against non-compliance of Solid Waste Management Rules, 2016, at Gurgaon, requiring segregation and scientific disposal of solid waste. Considering the grievance that bulk waste generators were not complying with the rules, the Tribunal directed the Municipal Corporation, Gurgaon to look into the matter and take remedial action.

The Tribunal has also dealt with the larger issue of the compliance of SWM Rules, 2016 in Gurugram vide order dated 23.09.2022 in O.A No. 172/2021, Poonam Yadav v. M/s Ecogreen energy Pvt. Ltd. & Ors. The Tribunal has constituted a monitoring Committee headed by Chairman, Haryana State PCB and comprising other concerned senior officers and also required deposit of Rs. 100 crores in a ring fenced account for compliance measures. In these circumstances, only further order can be to forward a copy of this order to the Municipal Corporation, Gurgaon to verify the factual position and if any violation is found, necessary action may be taken. The applicants are also at liberty to represent their grievance before the Committee constituted by the Tribunal.

The Application is disposed of.
