ORDER
The matter is taken up through Virtual Hearing (VC).
IA 2024/2021:- Counsel, Mr. Yash Jariwala appeared for the applicant. Counsel, Mr. Rohan Agarwal appeared for the Resolution Professional. The present application is filed under section 12A of the IBC Code, 2016 for withdrawal of the CP (IB) No. 3460/MB/2018. The applicant submits that the Financial Creditor has received One Time Settlement amount from the Corporate Debtor.
In view of the above, the Financial Creditor is allowed to withdraw the present Company Petition. Further, it is seen from the records that an IA bearing no. 803/2021 filed for exclusion of the CIRP is pending. In view of withdrawal of the present Company Petition the said IA along with other pending IA’s if any stands infructuous.
In view of the above, the CP (IB) No. 3460/MB/2018 stands disposed as withdrawn and IA 2024/2021 is disposed of. File be consigned to records.
