ORDER
The matter is taken up through Virtual Hearing (VC).
IA No. 1637/2022:- The present application is filed by the Interim Resolution Professional (Mr. Manoj Kumar Jain) applicant herein under Section 12A of the Insolvency and Bankruptcy Code, 2016 for withdrawal of the Company Petition. Counsel appearing for Interim Resolution Professional submits that the Corporate Debtor has paid full and final payment of Rs. 12,61,000/- to the Financial Creditor. Counsel further stated that HDFC Bank has confirmed the payment receipt of Rs. 12,61,000/- and no other dues or amount is outstanding against the Corporate Debtor i.e. Sakar Poultry Private Limited. Having considered the submissions of the Counsel appearing for the Interim Resolution Professional and in view of the consent terms arrived between the erstwhile directors of the Corporate Debtor and the Financial Creditor. This bench is of the considered view that since parties have settled the matter as full and final. Hence, on account of settlement agreement and payment of dues, nothing survives in the present Company Petition. Accordingly, C.P. (IB) No. 3664(MB)2019 rendered infructuous, hence stands closed. IA 1637/2022 is allowed and disposed of. File be consigned to records. All Pending IA’s/MA’s in this Company Petition become infructuous, hence stood dismissed.
