Judgment
This appeal has been filed against the order dated 23.01.2023 by which Learned Adjudicating Authority has continued the earlier order dated 03.01.2023 and has observed that the applications can be notified for pronouncement of order shortly in the week commencing from 30.01.2023. The Adjudicating Authority having been already directed the application to be notified for pronouncement in the next week, although submissions on merits have been made by both the parties, we are of the view that at this stage we need not express any opinion on the merits because that has to be addressed by the Adjudicating Authority while deciding the application.
Learned Senior Counsel Mr. Kapil Sibal appearing for the Appellant submits that he may be permitted to withdraw since he has filed the appeal questioning the order of the Adjudicating Authority which prohibited him to proceed with the challenge process.
Mr. Kapil Sibal submits that he may be permitted to withdraw the appeal, leaving all contentions open, we accept the prayer and permit the Appellant to withdraw the appeal without prejudice to any of the contention of either of the parties.
Appeal dismissed as withdrawn.
