Judgment
This Appeal has been filed against the Order dated 25th August, 2022. There is a delay of 15 days in filing the Appeal. The cause shown in the Affidavit is that Learned Counsel for the Appellant was unwell due to which Appeal could not be filed and delay was caused in filing the Appeal. Cause shown sufficient, delay in filing the Appeal is condoned. I.A. No. 93 of 2023 is allowed.
This Appeal has been filed against the Order dated 25th August, 2022 where the Adjudicating Authority has fixed the matter on 18th October, 2022 for hearing.
Learned Counsel for the Appellant submits that on 18.10.2022 and thereafter on a further date hearing could not be held and now date has been fixed on 03rd January, 2023.
In view of the fact that the Adjudicating Authority has already fixed a date for hearing on 03rd January, 2023, we see no reason to entertain this Appeal. We only request the Adjudicating Authority to decide the Application at an early date it having been filed in 2019.
The appeal is disposed of, accordingly.
