Heard learned counsel for the parties through video conferencing.

Petitioner was a student of class 10th in S.N. Public School, Sitarganj, District Udham Singh Nagar.

By means of this writ petition, petitioner has sought the following reliefs:-

“a) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 4 & 5 to permit the petitioner to attain class X.

b) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 4 & 5 to permit the petitioner to deposit all outstanding

amounts of remaining fee and monthly fee in the present academic year 2018-19.

c) Issue a writ, order or direction in the nature of mandamus directing the respondent No. 4 & 5 not to harass the petitioner.â€​

A Coordinate Bench of this Court passed an interim order on 09.07.2018, whereby the concerned school was directed to give admission to the

petitioner and allow him to attend the class, provided petitioner deposits at least half of the outstanding fee.

This Court can take judicial notice of the fact that petitioner must have pursued his 10th standard in terms of order of this Court, therefore, the

reliefs as claimed in the writ petition, do not survive.

Accordingly, writ petition is dismissed as infructuous.
