Judgment
Ravindra Maithani, J
Applicant Virendra Kumar is in judicial custody in Case Crime No.02 of 2022, under Sections 302, 201, 34, 392, 411 IPC, Revenue Police Thana Udeypur, Bhikiyasain District- Almora. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
It is argued by learned counsel for the applicant that co-accused Sunil Singh Bisht, having similar role, has already been granted bail by this Court in BA1 No.228 of 2023 on 21.03.2023. It is also submitted that from the possession of the co-accused, motorcycle was allegedly recovered, a few days after the alleged incident, whereas, a recovery of Rs. 12,000/- has been allegedly made from the applicant after more than a month.
These facts are not disputed by learned State Counsel.
Having considered, this Court is of the view that it is a case fit for bail and the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
