Judgment
Ravindra Maithani, J
Applicant is in judicial custody in Case Crime No.274 of 2023, under Sections 380, 411, 420, 454 & 34 IPC, Police Station Doiwala, District Dehradun. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
It is argued that this is the second bail application of the applicant. The first bail application has been rejected on merits on 16.05.2024.
Learned counsel for the applicant would submit that after rejection of the first bail application of the applicant, one of the co-accused having similar role has already been enlarged on bail.
Learned State Counsel admits this fact.
Having considered, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
