Judgment
By way of the present OA filed u/s 19 of the Administrative Tribunals Act, 1985, the applicant has prayed for the following reliefs:-
“8.1To quash and set aside the office transfer order dated 11/03/2024 to an extent whereby the applicant is being transferred from SRO, Rohini, Delhi to DM, Delhi (the name of the applicant is at serial no. 234 for in aforesaid transfer order/Annexure – 1)
And
8.2To transfer the applicant from SRO, Rohini, Delhi to SRO, Gurugram which is permanent address H. No. 463, Ward No. 5, Near Bypass Sohna, Gurgaon – 122103
Or
8.3To stay the transfer from SRO, Rohini, Delhi, and retain the applicant at SRO, Rohini, Delhi, near present address which is 5 km from the residence
Or And
8.4Pass any order/relief/direction (s) as this Hon’ble Tribunal may deem fit and proper in the interest of justice in favour of the applicant.”
Learned counsel for the applicant submits that for redressal of his grievances, the applicant has preferred representation dated 15.03.2024 (Annexure A-2) (wrongly typed as 13.03.2024). However, the same is not considered and disposed of by the respondents till date. Therefore, the present OA.
Issue notice to the respondents. Mr. Amit Chawla, who appears for the respondents in advance service, accepts notice.
Learned counsel for the applicant submits that the applicant shall be satisfied if the present OA is disposed of at this very stage with a direction to the respondents to consider the applicant’s aforesaid representation in a time bound manner. There is no objection to the prayer from learned counsel for the respondents.
In view of the aforesaid, without going into merit and with the consent of the learned counsels appearing for the parties, OA is disposed of with a direction to the Competent Authority amongst the respondents to consider the applicant’s aforesaid pending representation and dispose of the same by passing a reasoned and speaking order as expeditiously as possible and preferably within four weeks from the date of receipt of copy of this Order.
In view of the aforesaid terms, OA stands disposed of. Associated MA also stands disposed of accordingly. No order as to costs.
