Judgment

The applicant is working as a Teacher in the Directorate of Education, NCT of Delhi. He found that his ACRs for the year 2013-14 and 2015-16 were recorded as below benchmark. He made a representation to the Deputy Director on 30.01.2017 with a request to upgrade the ACRs. His grievance is that no action has been taken thereon. This OA is filed with a prayer to quash the adverse entries in the ACRs for the period referred above.
We heard Ms. Jasvinder kaur, learned counsel for the applicant and Mr. Rohit Bhagat for Mr. Saurabh Chadda, learned counsel for respondent No. 3.
Basically, the applicant is under a mistaken impression that adverse entries were made in his ACRs for the year 2013-14 and 2015-16. There are no adverse entries as such but the ACRs are found to be below benchmark, in the context of promotion. In such cases, representation for upgradation of ACRs is required to be made to the competent authority. We find from the representation made by the applicant is that his representation that it is totally irrelevant and imperfect. The applicant proceeded on the assumption that there are adverse entries and accordingly wanted to get them expunged. The question of expunging would arise, if only, any entries recorded against him. Since the effort is upgradation of the ACRs, a representation is required to made by the applicant for that purpose.
We, therefore, dispose of the OA leaving it open to the applicant, to make a representation for upgradation of his ACRs duly stating relevant reasons, within four weeks from today. If such a representation is made, the respondents shall dispose of the same within three months thereafter.
There shall be no order as to costs.
