Judgment

Though this matter is of the year 2014, the same has remained pending for admission since last 9 years. In between, learned advocate who was appearing for the petitioners has been elevated to the Bench of this Court and, therefore, fresh notice was issued to the petitioners. However, no one has appeared on behalf of the petitioners and hence, Mr. Adityasinh Jadeja, learned AGP was asked to inquire about the latest status of the land in question.
Learned AGP, upon instructions received by him from the concerned Officer, states that prima facie, it seems that the grievance of the petitioner has been redressed as legal heirs of the petitioners are in joint possession of the land in question with the private respondent Nos.5 to 7 who are represented by learned advocate Mr. Japan Dave.
Learned advocate Mr. Japan Dave does not have any instruction about the same.
In view of the fact that despite service of notice, the petitioner or any of the legal heirs of the petitioner has appeared and in view of the statement made by learned AGP Mr. Jadeja, prima facie, it seems that the grievance of the petitioners stands redressed. Hence the present petition stands disposed of. However, in case of difficulty, the petitioner may file fresh petition in respect of the grievance of the petitioner. Notice is discharged. No order as to costs.
Needless to say that this Court has not examined the merits of the matter. Rights and contentions of all the parties are kept open.
