CRL.M.(BAIL) 268/2020 (For suspension of sentence)

The hearing has been conducted through Video Conferencing.

By this application, the appellant had sought interim suspension of sentence on the ground that his father has been diagnosed with Hepatitis-B and is

suffering from kidney failure.

On urgent mentioning, the present application for suspension of sentence has been listed for hearing through Video Conferencing.

A status report has been filed by the State verifying the medical condition of the parents of the appellant. As per the status report, both the parents

of the appellant are admitted in Fortis-Escorts Hospital, Okhla, New Delhi. Father of the appellant is suffering from Nephropathy with end stage renal

disease and is on maintenance hemodialysis coupled with chronic liver disease. He is also a patient of Hypertension, admitted at the hospital with

lower respiratory tract infections fluid overload. Father of the appellant has been managed with antibiotics, dialysis, anti-hypertension drugs and other

supportive measures and is likely to be discharged in a few days.

As per the report of the mother of the appellant, she had complaints of breathlessness, cough with sputum and her Haemoglobin was also low.

Mother was also administered anti-biotics, bronchodilators, nebulizations etc. and was given support by BIPAP. She is also likely to be discharged in a

few days.

Considering the fact that both the parents of the appellant are unwell and that earlier also, the sentence of the appellant was suspended by this

Court and there is no allegation that the appellant misused the said concession, this Court deems it fit to suspend the sentence of the appellant for a

period of four weeks on his furnishing a personal bond in the sum of Rs. 50000/- with two sureties of the like amount subject to the satisfaction of the

Duty Magistrate.
