Judgment
This Application seeks execution of order of this Tribunal dated 03.01.2022 read with further order dated 18.05.2022 on the issue of construction of toilets in flood plain zone of river Ganga by the Municipal Corporation, Rishikesh and discharge of untreated waste therefrom in river Ganga.
Vide order dated 03.01.2022, the Tribunal directed the Municipal Corporation, Rishikesh to ensure that the construction in flood plain zone was not permanent. Thereafter, vide order dated 18.05.2022, grievance of the applicant that there was unabated pollution in the filter trench of the Dam connected to holy river Ganga, was directed to be looked into by the Chief Secretary, Uttarakhand. According to the applicant, the violation is still continuing.
Having regard to the nature of the issue, we direct that a copy of the order dated 03.01.2022 be forwarded by the registry to the District Judge, Dehradun under Section 25 (2) of the NGT Act, 2010 for being transferred to the concerned Civil Court for execution in accordance with law.
The Application is disposed of.
