Judgment
By Hon’ble Mr. Justice Rajiv Joshi, Member (Judicial) :
Shri Vinod Kumar, learned counsel for the applicant and Shri Anil Kumar, learned counsel for the respondents are present.
The instant Original Application has been filed by the applicant under Section 19 of Administrative Tribunal, Act, 1985 for the following relief(s) :-
“(i)To issue an order or direction in the suitable nature directing the respondent department to consider the application of the applicant in respect of age relaxation and permit him to make his registration and applying the form under the GDCE notification no. NER/RRC/GDCE/2026 dated 14.08.2026.
(ii)To issue any order or direction, which this Hon'ble Tribunal may deem fit and proper in the facts and circumstances of the case..
(iii)To award the cost of the application to the applicant.”
Learned counsel for the applicant submitted that as per the notification of Railway Recruitment Cell, N.E. Railway, Gorakpur, the following information was given by Assistant Secretary, which is given below :-

(रोजगार सूचना सं० एनईआर/आरआरसी/जीडीसीई/2024 दिनांक 21.11.2024)
रेलवे बोर्ड के पत्र सं० E(NG) I/2025/PM1/3 दिनांक 05.03.2025 के निर्देश एवं सक्षम अधिकारी के अनुमोदन से सामान्य विभागीय प्रतियोगी परीक्षा (जीडीसीई) चयन जो आरआरसी/एनईआर/गोरखपुर द्वारा प्रक्रियाधीन है और अभी तक अन्तिम रूप नहीं दिया गया है, वर्तमान में कराई जाने वाली जीडीसीई चयन अगले आदेश तक रद्द माना जाए।

Learned counsel for the applicant submitted that against the impugned notification dated 14.08.2026, the applicant has filed the representation dated 19.09.2026, which is still pending. Learned counsel for the applicant further submitted that his grievance shall be redressed if a direction is given to the respondents to consider and decide the pending representation dated 19.09.2026 (Annexure-A-7) of the applicant by passing a reasoned and speaking order within a time bound manner.
Learned counsel for the respondents has opposed the prayer of the applicant.
However, in view of the limited prayer made by learned counsel for the applicant, no fruitful purpose will be served in keeping this O.A. pending. Accordingly, the OA is disposed of at the admission stage itself with direction to competent authority amongst the respondents to consider and decide the pending representation dated 19.09.2026 (Annexure-A-7) of the applicant by passing a reasoned and speaking order within a period of two weeks from the date of receipt of a certified copy of this order. The order so passed shall be communicated to the applicant without any delay. No order as to costs.
It is made clear that this Tribunal has not expressed any opinion on the merits of the case.
All MAs pending in this O.A. also stand disposed off.
