O R D E R
IA (IBC) 1002/2022:-
Ld. Counsel Shri. Raja Shekar Rao Salvaji for the applicant/Operational Creditor present. This is an application filed pursuant to the order dated 23.03.2022 where under CP (IB) No. 65/9/HDB/2020 has been disposed of by giving liberty to seek restoration of the Company Petition, in the event if the Operational Creditor in the CP (IB) No. 663/9/HDB/2019 withdraws the Company Petition by virtue of settlement with the Corporate Debtor. It is now represented that the CP (IB) No. 663/9/HDB/2019 has been withdrawn pursuant to a settlement and Section 12A has been filed by the IRP, which was ordered on 27.06.2022. Therefore, under the circumstances the order of this Adjudicating Authority dated 22.03.2022 to the extent of disposal of CP (IB) No. 65/9/HDB/2020 is hereby recalled and the same is restored for hearing. Let the Operational Creditor take notice to the Corporate Debtor through speed post within three days from today and file proof of service before next hearing date. IA is accordingly disposed of.
