Learned Proxy Counsel Ms.Divya, for Corporate Debtor appeared via video conference.
Since corporate debtor in this case has been put into CIRP in CP (IB) No.663/9/HDB/2019, on 22.03.2022. In the light of the same, Learned Counsel for operational creditor is directed to approach the Interim Resolution Professional (IRP) and IRP to consider the same as per the provisions of law.
Accordingly, CP (IB) No.53/9/HDB/2021 is disposed of with a liberty to the operational creditor to seek restoration of the petition in the event the operational creditor in CP No.663/9/HDB/2019, withdraws the said Company Petition under a settlement.
