Judgment
Grievance in this application is against construction raised by respondent no. 7, Lohchab Motor Company Pvt. Ltd., at Khasra No. 11/6 (2-16), village Kutana, Tehsil and District Rohtak, Haryana, which is green belt zone. Such construction will adversely affect the environment. It is further stated that the Municipal Corporation, Rohtak issued notice dated 30.06.2021 to the effect that the construction was in violation of Haryana Municipal Act, 1994. FIR dated 11.08.2021 has been lodged on that ground. The applicant made complaint dated 07.07.2021 to the District Town Planner which was also forwarded to the Municipal Corporation, Rohtak. Thus, it is stated that the illegality remains unremedied.
We are of the view that the issue needs to be first looked into at the level of Municipal Corporation, Rohtak and the Deputy Commissioner, Rohtak on its own merit. Ordered accordingly. It is made clear that we have not expressed any opinion on merits.
The application is disposed of.
