Heard counsel appearing for the petitioner and counsel appearing for the State. Petitioner is apprehending his arrest in connection with the case registered under Sections 414/34 of the Indian Penal Code in connection with Balidih P.S. Case No. 61 of 2012 corresponding to G.R. No. 807 of 2012 pending in the Court of Chief Judicial Magistrate, Bokaro.

Counsel appearing for the petitioner has submitted that the petitioner''s name has come only on confession of the co-accused.

Counsel appearing for the State has contended that the petitioner is the person who is doing the business of illegal coal transporting through the cyclist and then the said cyclist loaded with coal on the cycle were arrested by the police and they have given the name of the petitioner. He has further contended that the petitioner is already involved in four cases of similar nature. Considering the submissions made by both the parties and considering the fact that the petitioner is involved in number of criminal cases of similar nature, actively involved in clandestine business of coal, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
