The present Application has been filed by the applicant under Section 19 of the Administrative Tribunals Act, 1985 on being aggrieved by inaction of the respondents on his representations dated 14.7.2020 and 5.8.2020 (Annexure A/1 Colly).

Shri Tripathi, learned counsel for the applicant, submits that in pursuance of circular dated 13.7.2020 of Directorate of Education, the applicant has shown his willingness for rendering his online services. However, till date no decision has been taken or communicated to him by the respondents.

Issue notice.

Ms. Esha Mazumdar, learned standing counsel for respondents, who appears on advance service, submits that the circular referred by the applicant only authorises the Head of School to indicate such person(s) where the Head of the School finds it necessary. She further submits on instructions that the concerned Head of School has informed that there is no requirement of Guest Teacher.

Shri Tripathi, learned counsel for the applicant, submits that concerned School is having a vacancy against which the applicant's services can be utilized by the respondents.

In view of the aforesaid facts and circumstances, the present OA is disposed of with direction to the respondents to consider the applicant's aforesaid representations dated 14.7.2020 and 5.8.2020 (Annexure A/1 Colly) keeping in view their own circular dated 13.7.2020 and to dispose of the same by passing a reasoned and speaking order as expeditiously as possible and in any case within a period of four weeks of receipt of a copy of this Order.

We make it clear that while passing the present Order, we have not gone into the merit of the claim of the applicant.

The OA is disposed of in aforesaid terms. No costs.
