O R D E R
PER HON’BLE JUSTICE ANIL KUMAR OJHA, MEMBER (J)
Heard learned counsel for the applicant, learned counsel for the respondents and perused the records.
Through this original application, applicant has prayed for the following relief(s):
“Wherefore, it is most respectfully prayed that the learned Tribunal may be pleased to set aside the order dated 27.01.2026 and direct the opposite converge accept application and grant old pension with parties to the all pensionary benefits along with 12% interest.”
At the outset, learned counsel for the applicant submitted that this OA may be disposed of by directing the respondents to extend the benefits of the O.M. No. 57/05/2021-P&PW(B)/Compassionate/10593 dated 22.06.2026 issued by Department of Pension and Pensioner welfare, Ministry of Personnel, Public Grievances and Pension, Government of India. The copy of the aforesaid OM is annexed with application for taking on record the aforesaid OM as Annexure No. 1 filed on 08.09.2026.
Learned counsel for the respondents conceded the aforesaid factual scenario.
In view of above, we deem it appropriate to direct the respondents / competent authority to pass the orders in the case of the applicant on the basis of O.M. No. 57/05/2021-P&PW(B)/Compassionate/10593 dated 22.06.2026 issued by Department of Pension and Pensioner welfare, Ministry of Personnel, Public Grievances and Pension, Government of India and extend the same benefits, if permissible according to law. The said exercise shall be completed within two months from the date of receipt of a certified copy of this order, the decision, so taken, be communicated to the applicant forthwith.
The OA is disposed of in the above terms. There is no order as to costs. Pending MAs, if any, also stand disposed of accordingly.
