Heard Mr. Sanjay Kumar Pandey- 2, learned counsel for the petitioner and Mr. S. K. Sinha, learned A.P.P. for the State.

The petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Gola P. S. Case No. 64 of 2016,

corresponding to G. R. No. 950 of 2016.

It has been alleged that the petitioner along with a large number of persons under the banner of Nagrik Chetna Manch had assembled at the main gate

of IPL Factory and started raising slogans and obstructed the functioning of the factory. When the police arrived, the agitators did not move but

somehow they were removed from the main gate. The agitators were being led by Rajiv Jaiswal with other unnamed persons supporting him.

It has been stated by the learned counsel for the petitioner that three more cases have been instituted against the petitioner with respect to the similar

allegation of making protests and raising genuine grievance. It has further been stated that several of the accused persons have been granted

anticipatory bail by this Court in A.B.A. No. 4942 of 2016.

Learned A.P.P. has opposed the prayer for anticipatory bail of the petitioner.

The allegations are general and omnibus in nature and the petitioner was a member of the mob who had prevented the factory from functioning but

the agitators were subsequently removed on the arrival of the police personnel.

Since the other similarly situated co-accused has already been granted anticipatory bail by this Court, the petitioner, therefore named above, is directed

to surrender in the court below within a period of four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of

Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class,

Ramgarh in connection with Gola P. S. Case No. 64 of 2016, corresponding to G. R. No. 950 of 2016, subject to the conditions as laid down under

Section 438(2) of the Code of Criminal Procedure.

This application stands allowed.
