The applicant has filed this application under Section 482 of CrPC for modification of bail order dated 28-06-2023 passed by this Court in MCRC 26922 of 2023, whereby applicant was granted bail.
It is submitted by learned counsel for the applicant that due to typographical error the earlier counsel for applicant could not mention sections i.e. Sections 409, 467, 468, 471 of IPC in the memo of bail application whereas, as per the case diary as well as impugned order of rejection, there has been specifically mentioned about the details of Sections.
Perused the case diary.
Considering the aforesaid mistake on the part of previous counsel for the applicant which is bona fide in nature, this application under Section 482 of CrPC is allowed. Aforesaid Sections i.e. Sections 409, 467, 468, 471 of IPC deserve to be inserted in paragraph one of previous bail order dated 28th of June, 2023 passed by this Court in MCRC 26922 of 2023 and this order be read as conjointly with the order dated 28th of June, 2023.
MCRC stands disposed of with aforesaid modification.
