This is an application under Section 482 of Cr.P.C. for correction/modification in the order dated 17.02.2023 passed in MCRC No.2176/2023.
The applicant has filed an application under Section 438 of Cr.P.C. seeking anticipatory bail which was rejected by the order, but due to inadvertence in the first para of the order, it has been mentioned as first application under Section 439 Cr.P.C.
Counsel for the State does not dispute that the said application was for grant of anticipatory bail.
Considering the same, the present petition is allowed and the first para of order dated 17.02.2023 in MCRC No.2176/2023 is modified and the same shall be read as first application under Section 438 of Cr.P.C . The application is allowed to that extent only. The rest of the order shall remain intact.
The order passed today shall be read conjointly with the order dated 17.02.2023 in MCRC No.2176/2023.
With the aforesaid, the application is allowed and disposed off.
