This is third application for grant of bail under section 439 Cr.P.C. for grant of bail in connection with FIR No.352/2022 registered at P.S. Dharampuri, district Dhar for the offence under sections 420, 466, 468, 471, 120-B, 182, 193 and 34 of IPC on the ground that seizure witnesses have been recorded.
The seizure witnesses have not turned hostile. They have supported the prosecution case.
Counsel for the applicant submits that seizure witnesses have not stated that alleged forged marksheet and birth certificates were produced by the applicant.
The prosecution case is that applicant is the Computer Operator and he has prepared forged marksheet and birth certificate which was being used for grant of bail in criminal cases. The seizure witnesses have admitted their signature on the seizure memo and have supported the prosecution case. Considering the serious allegation and also the fact that number of marksheets alleged to be forged, have been seized from the possession of applicant, no case for grant of bail to the applicant is made out.
M.Cr.C. is accordingly dismissed.
