Judgment
Mr.R.Parthiban, learned Special Government Pleader, takes notice for the respondents 1 to 4.
The Writ Petition is disposed of at the time of admission, after hearing the learned counsel for the petitioners and the learned Special Government Pleader appearing for the respondents 1 to 4.
It appears that the first petitioner is suffering from a kidney ailment and that the second petitioner has come forward to donate his kidney to the first petitioner. In this regard, the petitioners have made an application dated 29.08.2026 before the respondents 2 to 4, purportedly under the provisions of the Transplantation of Human Organs Act, 1994 (Act 42 of 1994).
The learned Special Government Pleader appearing for the respondents 1 to 4 submits that the second respondent requires three months' time to dispose of the representation.
Taking note of the fact that the first petitioner is already undergoing treatment in connection with his kidney ailment and considering the fact that the second petitioner has come forward to donate his kidney, I direct the second respondent to consider the application of the petitioners for kidney transplantation and pass appropriate orders on merits within a period of fifteen days from today, in the light of the decision of this Court in Sudha Mathesan and another v. The Authorisation Committee (Transplantation), represented by its Chairman, Coimbatore Medical College Hospital, Trichy Road, Coimbatore and another [W.P.Nos.13918, 13922, 13967 and 13969 of 2024, dated 30.05.2024].
With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs.
