Judgment
Mr.S.Venkatesh, learned Additional Government Pleader, takes notice for the respondents.
The Writ Petition is disposed of at the time of admission, after hearing the learned counsel for the petitioners and the learned Additional Government Pleader appearing for the respondents.
It appears that the first petitioner is suffering from a kidney ailment and that the second petitioner has come forward to donate her kidney to the first petitioner. In this regard, the petitioners have made an application dated 27.08.2026 before the first respondent, purportedly under the provisions of the Transplantation of Human Organs Act, 1994 (Act 42 of 1994).
The learned Additional Government Pleader appearing for the respondents submits that the petitioners ought to have filed an application before the third respondent and that, thereafter, the application/request of the petitioners can be considered. He further submits that the third respondent requires three months' time to dispose of the representation.
Taking note of the fact that the first petitioner is already undergoing treatment as an inpatient in the hospital in connection with his kidney ailment and considering the fact that the second petitioner has come forward to donate her kidney, I direct the third respondent to consider the application of the petitioners for kidney transplantation. Since a copy of the representation dated 27.08.2026 has not been furnished to the third respondent, the petitioners are directed to forward the same to the third respondent, who shall pass appropriate orders on merits within a period of fifteen days from the date of receipt of the said application, in the light of the decision of this Court in Sudha Mathesan and another v. The Authorisation Committee (Transplantation), represented by its Chairman, Coimbatore Medical College Hospital, Trichy Road, Coimbatore and another [W.P.Nos.13918, 13922, 13967 and 13969 of 2024, dated 30.05.2024].
With the above directions, this Writ Petition stands disposed of. No costs.
