This first application under Section 482 of Bhartiya Nagrik Suraksha Sanhita has been filed on behalf of the applicants for grant of anticipatory bail.
The applicants apprehending their arrest in connection with Crime No.118/2024 registered at police station-Ajaygarh District Panna for commission of offences punishable under Sections 420, 417/34 of IPC.
Prosecution story in brief is that the applicants purchased the land vide sale deed, which belongs to the Animal Husbandry Department, Ajaygarh District Panna.
Learned counsel for the applicants after arguing at length and unable to convince this Court about the exact khasra number of the land purchased by the applicants, prays for issuance of direction to the concerned police with regard to compliance of direction issued by the Hon'ble Supreme Court in the case of Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273 .
5 . So far as issuance of direction in the light of the Arnesh Kumar (supra), it is not incumbent because being a direction issued by the Hon'ble Supreme Court, the police is expected to follow the same upto the extent applicability thereof in the present case.
Prayer of withdrawal is allowed.
Accordingly, this MCRC stands dismissed as withdrawn with the aforesaid observation.
