This is first application under Section 482 of BNSS, for grant of anticipatory bail.
The applicants apprehend their arrest in connection with Crime No.06/2026 registered at Police Station Dinara District - Shivpuri (M.P) for the offences punishable under Sections 74, 308(1), 3(5) of BNS.
During the course of arguments, learned counsel for applicant requested to withdraw this application and also requested that direction may be issued to the Investigating Officer/Trial Court to comply with the directions of Hon'ble Apex Court in the Case of ArneshKumar Vs. State of Bihar [(2014) 8 SCC 273] and Satender Kumar Antil Vs. Central Bureau of Investigation [(2022) 10 SCC 51], Siddharth Vs. State of U.P. and anr. [(2022) 1 SCC 676] and Aman Preet Singh Vs. Central Bureau of Investigation [(2022) 13 SCC 764].
After considering the arguments, fact and circumstances of the case, request is accepted.
Accordingly, this application is dismissed as withdrawn.
However, it is expected that Investigating Officer/Trial Court shall ensure strict compliance of the guidelines and directions as laid down by Hon'ble Apex Court in the case of Arnesh Kumar (Supra), Satender Kumar Antil (Supra), Siddharth (supra) and Aman Preet Singh (supra).
